{"id":86497,"date":"2021-09-14T21:26:44","date_gmt":"2021-09-15T03:26:44","guid":{"rendered":"https:\/\/kuali.com.mx\/web\/?p=86497"},"modified":"2021-09-14T21:26:45","modified_gmt":"2021-09-15T03:26:45","slug":"protege-justicia-federal-al-charco-del-ingenio","status":"publish","type":"post","link":"https:\/\/kuali.com.mx\/web\/2021\/09\/14\/protege-justicia-federal-al-charco-del-ingenio\/","title":{"rendered":"PROTEGE JUSTICIA FEDERAL AL CHARCO DEL INGENIO"},"content":{"rendered":"\n<p><strong><em>Kuali\/San Miguel de Allende, Gto.-<\/em><\/strong>En respuesta a la demanda de amparo interpuesta en 2020 por vecinos de las colonias Balcones y Rinconada de Balcones de esta ciudad \u2013-26 firmantes en total--, solicitando mantener la integridad de la Zona de Preservaci\u00f3n Ecol\u00f3gica\u00a0<em>El Charco del Ingenio y Zonas Aleda\u00f1as<\/em>, un Tribunal Colegiado federal dict\u00f3 el pasado 05 de septiembre sentencia favorable a los quejosos. Con ella qued\u00f3 confirmada la nulidad de los acuerdos de Ayuntamiento de los a\u00f1os 2017 y 2018, los cuales pretend\u00edan sustraer decenas de hect\u00e1reas a la zona ecol\u00f3gica, as\u00ed como introducir cambios de uso de suelo que abrir\u00edan la puerta al desarrollo urbano y los negocios inmobiliarios al interior de la reserva natural.<\/p>\n\n\n\n<p>El amparo ahora otorgado por los tres magistrados del Tribunal federal, &nbsp;se suma a la sentencia en el mismo sentido emitida recientemente por el Tribunal de Justicia Administrativa de Guanajuato, impidiendo de manera contundente cualquier intento de alteraci\u00f3n de la zona protegida, y prohibiendo que las pretendidas modificaciones puedan ser incluidas en el Programa Municipal de Desarrollo Urbano y Ordenamiento Ecol\u00f3gico y Territorial 20-40 (PMDUOET).<\/p>\n\n\n\n<p>Esta reserva natural de 392 hect\u00e1reas, declarada oficialmente por el Municipio y vigente desde 2006, comprende zonas de gran valor ecol\u00f3gico, esc\u00e9nico e hist\u00f3rico, como las ca\u00f1adas del Obraje y del Charco del Ingenio, el Jard\u00edn Bot\u00e1nico, el Parque Landeta, varias secciones del Parque Bicentenario y humedales dotados de abundante vida silvestre. Asimismo comprende en derredor zonas de amortiguamiento, donde se localizan proyectos inmobiliarios como Garambullos y Santa Mar\u00eda del Obraje, los cuales est\u00e1n obligados a respetar las densidades habitacionales y alturas constructivas establecidas en la Declaratoria y ratificadas por los tribunales tanto del Estado como \u2013ahora-- de la Federaci\u00f3n.<\/p>\n\n\n\n<p>La sentencia de Amparo expedida por los magistrados es un documento exhaustivo y fundado en los derechos humanos consagrados en la Constituci\u00f3n, como el derecho a un medio ambiente sano y el derecho al agua, ambos amenazados en San Miguel de Allende por la proliferaci\u00f3n irresponsable de desarrollos inmobiliarios, impulsada por los recientes gobiernos municipales.
