{"id":61773,"date":"2019-10-23T16:15:40","date_gmt":"2019-10-23T22:15:40","guid":{"rendered":"http:\/\/kuali.com.mx\/web\/?p=61773"},"modified":"2019-10-23T16:15:40","modified_gmt":"2019-10-23T22:15:40","slug":"inconforma-a-club-deportivo-leon-fallo-a-favor-de-zermeno","status":"publish","type":"post","link":"https:\/\/kuali.com.mx\/web\/2019\/10\/23\/inconforma-a-club-deportivo-leon-fallo-a-favor-de-zermeno\/","title":{"rendered":"INCONFORMA A CLUB DEPORTIVO LE\u00d3N FALL\u00d3 A FAVOR DE ZERME\u00d1O"},"content":{"rendered":"<p><em><strong>Carolina Esqueda\/Le\u00f3n, Gto<\/strong><\/em>.-El representante legal de los \u00fanicos due\u00f1os leg\u00edtimos del Club Social y Deportivo Le\u00f3n A.C., Octavio L\u00f3pez de Alba, adelant\u00f3 que no se quedar\u00e1n de brazos cruzados ante la inminente entrega del estadio Nou Camp a la familia de Roberto Zerme\u00f1o y su socio H\u00e9ctor Gonz\u00e1lez Gonz\u00e1lez, dado que la ratificaci\u00f3n del fallo de la Corte Suprema de Justicia de la Naci\u00f3n se hizo bas\u00e1ndose en documentos ilegales.<\/p>\n<p><!--more--><\/p>\n<p>Acompa\u00f1ado del representante de los due\u00f1os de palcos y plateas, Francisco Hern\u00e1ndez Gonz\u00e1lez, el panel mostr\u00f3 los documentos donde se exhiben las irregularidades tanto de las escrituras ostentadas por los Zerme\u00f1o para demandar como due\u00f1os leg\u00edtimos del estadio, as\u00ed como del reconocimiento de la fiduciaria Banco del Baj\u00edo como el \u00fanico custodio legal del inmueble, que nunca estuvo en manos del municipio y por lo tanto no puede entregar lo que no tiene.<\/p>\n<p>La sentencia estableci\u00f3 hasta el 31 de octubre para que el municipio haga la entrega f\u00edsica del inmueble a los representantes del Club Social y Deportivo de Le\u00f3n, que es una sociedad distinta de la original, fundada por un grupo donde los \u00fanicos herederos leg\u00edtimos son Alfonso S\u00e1nchez L\u00f3pez y Guillermo Liceaga, tienen la escritura de las tierras desde 1945 y en 1963 fueron reconocidos por la Secretar\u00eda de Relaciones Exteriores para seguir utilizando el nombre de Club Social y Deportivo Le\u00f3n A.C.<\/p>\n<p>\u201cNada que ver una cosa con la otra, ese ente jur\u00eddico no existe y por lo tanto les insisto, en donde se encuentre que venga y recoja el patrimonio del Club Social y Deportivo Le\u00f3n. El municipio puede presentar su documento y decir no da lugar a acuerdo porque yo no te tengo qu\u00e9 entregar el patrimonio, quien te lo tiene que entregar y estuvo en custodia durante toda la administraci\u00f3n fue la fiduciaria Banco del Baj\u00edo\u201d dijo L\u00f3pez de Alba al respecto.<\/p>\n<p>El representante legal de los herederos leg\u00edtimos asegur\u00f3 que las escrituras presentadas por los Zerme\u00f1o carecen de validez legal, por lo que la primera l\u00ednea de defensa ser\u00e1 solicitar una revisi\u00f3n del documento a la Secretar\u00eda de Gobierno y a la direcci\u00f3n de Notar\u00edas, para comprobar que son una ilegalidad que no tiene trascendencia jur\u00eddica y bajo ning\u00fan motivo deber\u00edan aceptarlas para juicio.<\/p>\n<p>\u201cSe debe hacer seg\u00fan la escritura de ellos, cada a\u00f1o, el acta de la asamblea y no sabemos si ya no tienen facultades y atribuciones ni Roberto Ad\u00e1n Zerme\u00f1o Reyes y la situaci\u00f3n de H\u00e9ctor Gonz\u00e1lez Gonz\u00e1lez, si no acreditan ante el juzgado, no pueden exigirle la entrega a alguien que desconocen. Aparte cuando hacen el Fideicomiso se llama Roberto Zerme\u00f1o Reyes y cuando viene a presentar la demanda se llama Roberto Ad\u00e1n Zerme\u00f1o Reyes, no es el mismo y el juez debi\u00f3 rechazarlo\u201d expres\u00f3 Octavio L\u00f3pez.<\/p>\n<p>En una segunda v\u00eda presentar\u00e1n una queja ante la Suprema Corte y al Consejo de la Judicatura Federal para investigar al juez que otorg\u00f3 el fallo, Juan Gabriel S\u00e1nchez Iriarte de Zacatecas, por haber dictado una sentencia a una persona que no existe.
