{"id":121355,"date":"2023-06-29T20:20:50","date_gmt":"2023-06-30T02:20:50","guid":{"rendered":"https:\/\/kuali.com.mx\/web\/?p=121355"},"modified":"2023-06-29T23:52:47","modified_gmt":"2023-06-30T05:52:47","slug":"modifican-ley-para-proteger-derechos-laborales-de-embarazadas","status":"publish","type":"post","link":"https:\/\/kuali.com.mx\/web\/2023\/06\/29\/modifican-ley-para-proteger-derechos-laborales-de-embarazadas\/","title":{"rendered":"MODIFICAN LEY PARA PROTEGER DERECHOS LABORALES DE EMBARAZADAS"},"content":{"rendered":"\n<p><strong>Kuali\/Guanajuato, Gto.-<\/strong> &nbsp;EL Congreso del Estado de Guanajuato aprob\u00f3, por unanimidad, cambios a la Ley de Acceso de las Mujeres a una Vida Libre de Violencia para el Estado para proteger los derechos laborales de las mujeres embarazadas.<\/p>\n\n\n\n<p>Con las reformas se busca impedir que sean despedidas, coaccionadas a renunciar, a pedir permiso, licencia sin goce de sueldo o cualquier otra forma de separaci\u00f3n de su empleo mientras se encuentre en ese estado.<\/p>\n\n\n\n<p>Las reformas contemplan la ampliaci\u00f3n de la definici\u00f3n de violencia laboral que se define como todo acto u omisi\u00f3n en abuso de poder sin importar la relaci\u00f3n jer\u00e1rquica que, da\u00f1a la autoestima, salud, integridad, libertad y seguridad de la v\u00edctima e impide su desarrollo.<\/p>\n\n\n\n<p>Se contempla que la violencia laboral puede abarcar uno o varios eventos que producen un da\u00f1o, en el que se incluye el acoso u hostigamiento sexual; la negativa ilegal a contratar a la v\u00edctima, respetar su permanencia o condiciones generales de trabajo, la descalificaci\u00f3n del trabajo realizado, amenazas, intimidaci\u00f3n, humillaciones o explotaci\u00f3n.<\/p>\n\n\n\n<p>Tambi\u00e9n se incluyen los supuestos de despido o estar involucrado en la renuncia de una trabajadora por estar embarazada, por cambio de estado civil, por tener el cuidado de sus hijas o hijos menores; as\u00ed como el impedimento a llevar a cabo el periodo de lactancia y todo tipo de discriminaci\u00f3n por condici\u00f3n de g\u00e9nero.<\/p>\n\n\n\n<p>Al hablar a favor, la diputada Yulma Rocha Aguilar reconoci\u00f3 el trabajo realizado por la comisi\u00f3n, ya que permiti\u00f3 el perfeccionamiento de la iniciativa en favor del desarrollo laboral de las mujeres al ampliar el concepto de violencia laboral e incluir el despido o la coacci\u00f3n a una trabajadora para que renuncie por estar embarazada, cambiar su estado civil o deber cuidar de sus hijas e hijos, entre otros elementos que generan desigualdad.<\/p>\n\n\n\n<p>&nbsp;Por su parte, el congresista Gustavo Adolfo Alfaro Reyes manifest\u00f3 que las reformas propuestas buscan mitigar toda desventaja de las mujeres cuando se encuentran en condiciones de embarazo o en lactancia debido a los diversos casos en los que se le obliga a renunciar o solicitar licencias sin goce de sueldo, cuando en ocasiones son las que se encargan de la manutenci\u00f3n y responsabilidades de sus hijos.
